"Mom," Derek pushed CJ until she fell off the bed. "Oops."

"What?" CJ sat up and looked around.

"It's seven," Derek couldn't help but smile at CJ's hair standing straight up. "Where's dad?"

"He went to work."

"This early?"

"Yes."

"Are you lying?"

"No," CJ said and walked out. "I need to feed..."

"Uncle David and I feed and changed them already," Derek smiled.

"Really?" CJ smiled back. "Thank you honey."

"You're welcome."

"Your ready for school?" CJ smiled.

"You had to ruin the moment, didn't you?" Derek moaned.

OVAL OFFICE

"What are you doing here?" Leo asked, walking into Toby's office. "And what is that smell?"

"I didn't have any other clothes," Toby looked down at his suit.

"Is that alcohol?" Leo asked.

"I missed my mouth a few times," Toby shrugged.

"Are you drunk?" Leo snapped.

"I was last night. Now I just have a headache," Toby put his head back down on his desk.

"I'm sorry to hear that!" Leo screamed and walked out.

"Ouch," Toby moaned at the pain in his head.

"Here," Ginger walked in. "Sam told me to get you a suit."

"Thanks," Toby nodded. "Do I look okay?"

"You look like you slept in a dumpster," Ginger said.

"Thanks," Toby said sarcastically.

"Sure," Ginger smiled and walked out.

Josh walked into Toby's office. "Toby, I need you to..." He started laughing.

"And what is so funny?" Toby moaned.

"It's just that I remember when I looked the same way after that bachelor party two years ago," he said between laughs.

"Shut up."

"Josh, go away. He's got a headache and needs to change," Sam said.

"Who are you, his mom?"

"If you don't leave now, I'll tell everyone here what you did the night before the election." Sam looked him in the eye.

"I'm gone." Josh nearly ran away to his office.

CJ AND TOBY'S HOUSE

"You ready," CJ asked Derek as he came down the stairs.

"Yeah...But can Uncle David take me to school?"

"Nope. He wanted to take a jog so he's out running somewhere."

"Darn!" He got his backpack.

CJ smiled a little. "Sorry kiddo. Hey will you answer that," she said when the doorbell rang.

"Okay." He went to the door and opened it. It was the babysitter. "Laura's here mom."

"Ah, good. I'm glad you could come, even though it'll only be for a little while. My brother-in-law is here."

"That's fine," she said. "You should probably go."

"Oh that's okay, we don't have to." Derek said.

"Come on smartly," CJ said as she took his hand and pulled him out to the garage.

"Mom?"

"Yeah?"

"Where is dad, really," he asked as the two got into the car.

"He's at work," CJ said again.

"But where was he last night?"

"We had a small fight, so he stayed with Sam to cool off."

"Will he be back tonight?"

"No."

"Why?"

"Because he won't win this time."

"What?" Derek asked, confused.

"Don't worry about it," CJ said.

TOBY'S OFFICE

"Hey," Sam walked in. "You look a little better."

"That's because I changed," Toby mentioned. "Where's the report on the CAO?"

"We finished that," Sam mentioned.

"Oh," Toby shrugged.

"You should talk with her."

"Who?"

"CJ."

"NO."

"Toby, I knew this was going to be a problem. Both of you are the most stubborn people I know. If you two wait for the other one to apologize, you will never make-up."

"Maybe I shouldn't have done this. Maybe we were just better off as friends," Toby mentioned.

"Do you love her?"

"Yes."

"How much?"

"With all I have."

"So how can you think that?" Sam asked.

"I don't know," Toby moaned and sat down. "I didn't mean it."

"Talk to her."

"Sam, as much as I would love to go home and see my kids. I'm not going to give CJ the pleasure of seeing me apologize."

"What about Derek?"

"I was going to surprise him at lunch time at his school."

"That's nice," Sam smiled.

"Do I still look bad?"

"Yep," Sam said honestly and walked out.

Toby sighed and finally changed into the other suit. He went to the bathroom and put cold water on his face. He knew he was wrong but he wasn't going to let CJ win. Not this time.

CJ's CAR

"Have a good day at school," CJ said as she watched Derek get out of the car.

"I will." He turned and walked into the building. His plan had to work. It simply had to.

CJ got to work and made sure to avoid walking through the bullpen to get to her office. She wasn't going to let Toby win.
