"I'm going to make some calls," Sam walked in the kitchen as Toby walked Jack back to the bedroom.

"Toby, can I tell you something?" Jack asked.

"Sure."

"Is it bad that I don't want to go back with her?" Jack asked, sitting on the bed.

"No," Toby sat next to him. "I'm going to do everything in my power to make sure that doesn't happen."

"She hurts me," Jack cried.

"I know," Toby wrapped him arms around him to calm him down. "You know. Sam's a pretty good guy."

"Yeah, he seems okay. I mean. He has a hard head."

"I've always told that," Toby laughed.

"What's going on?" Sam asked.

"Toby was making fun of your head," Jack smiled.

"He started it," Toby started tickling Jack.

"CJ's on the phone," Sam smiled. "She wants to talk to you. She's mad."

"What did I do?" Toby moaned.

"You didn't call her when you first got here."

"I told her..."

"It's CJ," Sam pointed out.

"I'm in trouble, huh?" Toby pouted.

"This is the reason I'm not ever getting married," Jack smirked.

Toby took the phone from Sam. "Hi C--"

"Shut up Toby!" She yelled.

"CJ, I'm sorry I didn't call. I had to--"

"You had better have a good excuse mister!"

"I do. I had to go to the police station and talk with Jack's mother who as it turns out really doesn't like her son."

"Oh." CJ sat down. "How's Jack?"

"He's doing alright. He's strong."

"He has to be," she said.

"Yeah. CJ, I don't know what is going to happen to him. I mean, I don't want him to have to go to a foster home."

She sighed, "Toby, this really isn't our business."

"Actually it is. Jack has no family, and we're the ones who he told about all of this."

"You have a point," she said.

"Of course I do." He smiled. "So how's Derek?"

"Well I told him what happened...He's okay though..."

"CJ, what's wrong?"

"He told me that Jack's mother hit him all of the time, not just here and there."

He sighed, "Okay, thanks for telling me. Listen, I have to get going. I'm going to talk to Sam and Jack. I'll be home in a few hours."

"Okay."

"And I may not be able to call--"

"Don't worry about it." She said as she got up.

"Okay, I'll see you later then. I love you."

"I love you too."

"Well?" Jack said as Toby walked back in.

"I think I'm out of the dog house," Toby smiled.

"So, what do we do now?" Jack asked.

"Well, it's too late to do anything tonight. But tomorrow we're going to go down and talk to someone about all of this."

"Foster care?" Jack snapped. "I'm not going..."

"Jack, no one is going to take you away. But you cannot go back with your mom."

"Where can I stay?"

"Well, you can stay here if you want," Sam mentioned.

"Thanks, but I don't want to make your life crazy."

"My life's already crazy. It would be fun."

"Really?" Jack smiled.

"Sure."

"That would be so cool."

"Well, now that we got that fixed," Toby smiled, as the phone starting ringing.

"Hello?" Sam answered it. "Toby, it's for you."

"Who is it?"

"Rhonda something," Sam handed the phone over to Toby.

"Yes," Toby answered.

"Why do you answer the phone like that?" Rhonda smirked.

"Because I can."

"Look, the mom wants to see you. She said something about wanting to talk."

"Okay, I'll be down in twenty minutes."

"I can't wait," Rhonda said sarcastically and hung up.

"That woman drives me crazy," Toby said to himself.

Sam laughed a little, "Sorry buddy."

"Shut up." He put his coat back on. "I'll be back soon...Or I might just go home."

"Okay," Sam said. "Have fun."

Toby rolled his eyes and left.

"Sam, I just realized, there's a problem."

"What's that," Sam asked, coming over to Jack.

"I don't have any extra clothes."

"Do you want to go your house and get some?"

"Okay," he said getting up.

"Let's go then." Sam put his coat on, as did Jack. He then grabbed his keys and the two left.

POLICE STATION

"Toby Ziegler," Rhonda said when he got there.

"Shut up," he muttered.

She laughed a little. "Ready to see her? An officer will be there so she won't be able to hit you this time."

"Thanks." He walked over to her. "Hello again."

She stood up. "You actually listened."

"Yeah. So what did you want to talk about," he asked.

"I want to keep him."

"Look, you know that's not going to happen."

She looked at him. "That little brat lies about everything. I don't hit him!"

"I believe Jack's word over yours," Toby defended.

"He's my son, I gave birth to him, I keep him, and that little check that comes in the mail each month."

"No, you won't," Ainsley walked in and put her briefcase on the table.

"And you are?"

"I'm Ainsley Hayes, Toby Ziegler and Sam Seaborn's attorney."

"What are you doing here?" Toby whispered in her ear.

"Sam called me and told me what's going on," She whispered back. "Ma'am, do you have any idea how much trouble you are in?"

"I'll be out by morning," She snapped.

"Maybe, but you won't get to see your son."

"And why not?"

"Because of this," Ainsley took out a piece of paper and handed it to Jack's mom. "It's a restraining order that orders you to stay at least two hundred feet away from Jack. Tomorrow, the courts will take in consideration of Sam adopting Jack."

"This is a joke, right?" She asked, shocked.

"I have witnesses that say they've seen you hit Jack, I have Jack willing to testify to you hitting him, and..."

"You know what?" She looked over at Toby. "Take the brat. He's been nothing but trouble from the beginning."

"So you never really loved him?" Toby asked, shocked.

"If I could have, I would have had an abortion! Take the brat."

"I have to get out of here," Toby said to Ainsley as he walked out of the room.

Ainsley turned to her, "If you don't obey this restraining order, you'll be back here again before you know it." She then left as well.

SAM'S APARTMENT

"Thanks for everything," Jack said as they walked into the apartment.

"It was my pleasure." Sam smiled. The phone then rang. "Just a sec, okay?"

"Yeah."

Sam went to the phone. "Hello?"

"Hi it's Toby."

"Hey, did it work?" Sam asked.

"Better than we thought it would. When did you call Ainsley?"

"When we were in the car."

"In the car?" Toby asked, confused.

"Well, Jack had to get a few things from his place so we went over there."

"Ah, okay. Well I'm going home."

"Okay, make sure to tell CJ."

He sighed, "Shut up."

"Yeah."

CJ AND TOBY'S HOUSE

"I'm back," Toby said, walking through the door.

"Hey, how'd it go," CJ asked.

He gestured for her to sit down. "It looks like Sam is going to take him."

"Really?"

"Yeah."

"Did I just hear what I think I heard?" A very happy Derek said.

"Hey, what are you doing down here," CJ asked in a serious tone.

"I heard dad come home."

Toby looked at Derek. "Jack's going to be living with Sam most likely."

"Really?!" He had a big smile on his face.

"Really. Now go do your homework."

"Okay." He ran back upstairs.

CJ smiled. "You're something else, Toby Ziegler."

"I know," he said, kissing her.
